Terms of service
The agreement between Pera and the organisations that use it. Plain English where we can manage it.
- Pera is for businesses and other organisations, not consumers.
- You’re responsible for having the right to add people and for telling them about Pera.
- Don’t try to work out who said what. That’s the one thing Pera exists to prevent.
- Paid plans are monthly, with no contract. Cancel whenever you like.
About these terms
Pera runs trypera.com and app.trypera.com. In these pages, “Pera”, “we” and “us” mean us. You can contact us at hello@trypera.com.
These terms apply when you create an account or use Pera (“the service”) on behalf of an organisation. By doing so, you confirm you have authority to agree to them for that organisation, which we call “you” below. Our privacy policy explains how we handle personal data.
The service
Pera sends anonymous check-ins to the people you add, collects their answers, and shows you the results. We may improve or change features over time. If we remove something important you’re paying for, we’ll tell you in advance.
Your account
- Keep your sign-in methods secure. You’re responsible for what happens in your account.
- Make sure the people you make admins are allowed to see your organisation’s results.
- Tell us straight away if you think someone has got into your account without permission.
Your responsibilities
When you add people to Pera, you are the controller of their data. You agree to:
- only add people you have a lawful basis to contact, such as your own staff
- tell them what Pera is, that answers are anonymous, and how you’ll use the results
- remove people when they no longer should receive check-ins
- handle any requests they make about their data, with our help where needed
Acceptable use
You must not:
- try to identify who gave a particular answer, or pressure anyone to say how they answered
- add people in small groups or with timing tricks designed to work out who answered
- use Pera to send spam, or to contact people who haven’t agreed to hear from you
- break the law, or upload anything harmful, abusive or that infringes someone else’s rights
- try to break, overload or get around the security of the service
If you do, we may suspend or close your account.
Anonymity and its limits
Pera is designed so answers can’t be linked to people, and so results only appear when enough people have answered. Here’s how. But comments are free text. If someone writes something that identifies them, Pera can’t prevent that. Please don’t act against anyone because of what you think they said.
Plans and payment
- The Free plan has the limits shown on our pricing page and has no time limit.
- The Team plan is billed at the end of each month, based on the number of people who were sent a check-in that month, with the minimum shown on our pricing page. Prices exclude VAT, which we add at the applicable rate.
- You can cancel a monthly plan at any time. You pay for the month you cancel in, and nothing after that.
- Organisation plans are annual contracts, on the terms we agree with you in writing.
- We may change our prices. We’ll give you at least 30 days’ notice, and the change applies from your next billing period.
- If a payment fails and isn’t fixed within 14 days, we may move you to the Free plan or pause your check-ins.
Data processing
When we process personal data for you, we act as your processor. We will: only process it on your documented instructions (these terms and your use of the service); make sure our staff are bound by confidentiality; keep it secure; only use sub-processors under contracts with equivalent protections, and tell you before adding new ones; help you respond to people’s requests and meet your security and breach obligations; delete or return the data when you leave; and give you the information you need to show compliance. If you need a signed data processing agreement, email us.
Your content
You own your data, including answers and notes. You give us permission to store and process it only to run the service for you. We own the Pera software, brand and website.
Availability
We work hard to keep Pera running, but we can’t promise it will always be available or free of errors. We may need to take it offline for maintenance, which we’ll try to do at quiet times.
Ending the agreement
You can stop using Pera at any time, and ask us to close your account by emailing us. We may end these terms with 30 days’ notice, or immediately if you seriously break them. When an account is closed, we delete its data as set out in our privacy policy. If you want a copy of your results first, ask us before it’s closed.
Liability
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that can’t be limited by law. Otherwise, we aren’t liable for indirect or consequential loss, or for loss of profit, revenue or data, and our total liability in any 12 months is limited to the amount you paid us in that period, or £100 if that’s more.
Pera helps you hear from your people. It isn’t legal advice, and using it doesn’t on its own mean you’ve met any legal duty, such as the duty to prevent sexual harassment or to assess the risk of work-related stress.
Changes to these terms
We may update these terms. If a change is significant, we’ll email you at least 30 days before it takes effect. If you keep using Pera after that, the new terms apply.
Governing law
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
